In a Pre Foreclosure Short Sale “Do I Need To Leave The Appliances?”

Most appliances are not part of the house and are the seller’s personal property. The sellers can take the appliances or sell them. The buyers are buying the house, and are not automatically entitled to free appliances.

This excludes appliances that are built-in or attached to the property, such as most dishwashers.

If you are in a short sale situation you are probably in financial survival mode. If you can’t afford new appliances or if you need the money, you should take the appliances with you or sell them. The appliances are your personal property just like your furniture and your clothing.

If you are moving into a rental and not sure if appliances will be provided, you should take the appliances with you.

I help dozens of families each year in Louisville avoid foreclosure by procuring short sales for them. Two additional commonly questions that sellers ask me are:

Question: The appliances came with the house. Don’t I need to leave them with the house?

Answer: No, you are not obligated to leave them. The appliances are your personal property. You can do with them as you wish.

Question: Should I leave the appliances to help the house sell?

Answer: The price of the house will sell the house, with or without the appliances. In a short sale the lender usually lets the house sell for less than market value. It’s cheaper for the lender to let it go now a discount than lose much more, later. Since the buyer will be getting a good deal on the house, they can live without you gifting them your appliances.

Your Realtor and a real estate attorney can advise you of your rights and responsibilities as it relates to appliances. Definitions of “attached to the property” can be points of contention after the contract is signed and you’re heading to closing. This is also true for other items such as lawn furniture, storage sheds and playsets.
