4. Is the short sale guaranteed to succeed?

  • No, unfortunately a short sale cannot be guaranteed to succeed every time – even though we are successful in overcoming extremely difficult challenges.
  • Sometimes the sellers themselves give up and stop cooperating as a result of the overwhelming life events that put them in a foreclosure situation.
  • Sometimes the banks are unreasonable due to self-defeating policies or bad information that they get from their appraisers. Banks will sometimes get an inaccurately highly appraisal which causes them to expect an unreasonably high short sale offer. Banks are known to turn down good, valid short sale offers, send the property to foreclosure and let the property sell at a greater loss than they would have incurred in the short sale.

5. Will I as the seller be kept informed of progress?

6. Who lists the property and finds the buyer?

  • Dave Halpern personally lists the property. Dave personally goes over the short sale process with the sellers.
  • Due to our aggressive marketing to other agents who represent buyers in the market- another agent will usually produce the buyer.  We often get multiple offers on properties- even in this slow market.
  • The Louisville Short Sale Expert Team handles the thousands of calls a year that we get from buyer’s agents, we handle all the showing coordinations, and process all the contracts. We do all the work.

7. Who negotiates the short sale?

8. Who pays the Realtor commission in a Short Sale?

9. Will Dave take every short sale?

  • Unfortunately, no.
  • Over the years we have come to recognize that some short sales are destined in advance to fail. We don’t want to give sellers false hope if we recognize that the short sale is unlikely to succeed.
  • Some of the variables include the severity of title problems, the level of cooperation that the sellers exhibit, and specific banks and lenders that we have learned are extremely uncooperative in short sale situations.
  • However, we have been successful in complicated situations that other Realtors thought were impossible to solve.  Please call us even if you have an extremely tough problem.

10. In what areas will Dave list short sales?

  • Since Dave will be the listing Realtor and his real estate license is in Kentucky, he will only accept short sales in Kentucky.
  • Dave is a member of the Greater Louisville Association of Realtors (GLAR) and is a member of the GLAR MLS system. Therefore, at this point, David will only list properties in areas that typically advertise properties on the GLAR MLS.
  • Dave’s particular area or areas of expertise are Jefferson County, Oldham County, Shelby County, Spencer County, and Nelson County. Other counties may be considered on a case-by-case basis.
