Short Sale Process
1. Who lists the property and finds the buyer?
- Dave Halpern personally lists the property. Dave personally goes over the short sale process with you, the sellers.
- The Louisville Short Sale Expert Team handles the thousands of calls a year that we get from buyer’s agents, we handle all the showing coordinations, and process all the contracts. We do all the work.
- You will be impressed with level of detail and preparedness that we bring to the table.
2. Who negotiates the short sale?
- The Louisville Short Sale Expert Team negotiates the short sale with the foreclosing lender and all junior lien holders.
- Short Sale negotiation is an extremely complicated and labor-intensive process. We have many years and many thousands of hours of experience.
- We do not outsource any of the short sale processing work. We stay on top of the ever changing industry processes and rules and hone our craft every day.
- The typical short sale per property requires dozens and sometimes hundreds of hours of skilled work above and beyond the listing and selling activity of real estate agent.

3. Will I, the seller, be kept informed of progress on my short sale?
- Absolutely yes.

- We will be in contact with you during the negotiation process with your lender
- We keep you informed when major milestones are achieved and we also give you interim updates. We welcome your calls at anytime to inquire status.
- We hold our relationship with you in high regard and we want you to stay knowledgeable about progress.
4. Who pays the real estate commission and closing costs for a short sale?
- The foreclosing lender pays the sellers closing costs and real estate commission. This means that typically you- the seller- has no fees.
5. Why would the lender pay the seller’s costs?
- If the lender forecloses they will have to resell the house and incur all these costs anyway. They prefer to let the house sell now through a short sale and pay your costs rather than spend time and money and end up losing more later.

7. Is the short sale guaranteed to succeed?
- No, unfortunately a short sale can not be guaranteed to succeed every time – even though we are successful in overcoming extremely difficult challenges.
- Sometimes the seller’s themselves give up and stop cooperating as a result of the overwhelming life events that put them in a foreclosure situation.
- Sometimes the banks are unreasonable due to self-defeating policies or bad information that they get from their appraisers. Banks will sometimes get an inaccurately highly appraisal which causes them to expect an unreasonably high short sale offer. Banks are known to turn down good, valid short sale offers, send the property to foreclosure and let the property sell at a greater loss than they would have incurred in the short sale.
